Terms and Conditions
This is an English translation for convenience. The Czech version is legally binding; in case of any discrepancy, the Czech version prevails. Česká verze
These Terms and Conditions govern the provision of the Evikom service — an operating system for small businesses covering mail and finance (documents, expenses and income, bank, papers for the accountant) and, according to the order, also records of stock, tapping to record consumption and orders, which we run on our own server and which the Customer accesses through a web browser.
These Terms are intended for businesses. We do not provide the service to consumers. The Customer enters into the contract in the course of its business, and therefore the provisions on consumer protection do not apply to it — in particular the right to withdraw from the contract within 14 days without giving a reason.
1. Who provides the service
- Provider: Vojtěch Suszka
- Company ID (IČO): 29649536
- Registered office: Čáslavská 1825/9, 737 01 Český Těšín
- Contact e-mail: podpora@pridom.cz
- Legal form: a self-employed natural person carrying on business under the Trade Licensing Act and entered in the Trade Register; the trade register is kept by the Municipal Office of Český Těšín
- VAT: Prices are final; we are not a VAT payer. What applies if the Provider becomes a VAT payer is set out in Article 5.
The Provider is a natural person carrying on business, not a company — therefore the Provider is not entered in the Commercial Register and has no file number. The address stated is the address of the Provider’s registered office according to the Trade Register.
Hereinafter the “Provider” or “we”. The “Customer” means a business with which a contract has been concluded under Article 3; hereinafter the “Customer” or “you”.
2. What the service is and is not
The service is a web application accessed from a browser on a computer, tablet or phone. The Customer installs nothing and does not run any server. The scope of the parts that are switched on (mail and finance, stock, tapping to record, orders, overviews, accounts and roles, and any others) is determined by the order or by agreement at set-up.
What the service is not: it is not a cash register system, it does not keep records of sales, it does not replace bookkeeping or stock records kept under legal regulations, and it is not a source of documents for tax purposes. The Customer is responsible for fulfilling its statutory obligations in the systems intended for that purpose. The data in the service is an operating record, not an accounting document.
Wages are entered into the service; the system does not calculate them. Overviews and totals in the Finance module (including taxes and insurance contributions) are indicative; the binding calculation is made by the Customer’s payroll accountant. The same applies to cost overviews and the matching of bank transactions — they serve operational decision-making, not as a basis for a tax return or for payments to the authorities.
The service is under development. We may add, change or discontinue individual parts; we will announce a substantial restriction or discontinuation of a part that the Customer uses in accordance with Article 18.
3. Formation and duration of the contract
The contract is formed by signing the order by both parties; confirmation of the order by e-mail from the Customer’s contact address is sufficient. Such a confirmation must contain the express acceptance of the provisions from the “Express acceptance of special provisions” part of the order and a confirmation that the Customer has received these Terms; without that, no contract is formed by e-mail. The order specifies the scope of the service, the price and the launch date, and these Terms form an integral part of it — the Customer receives them together with the order. A marketing offer or a price list does not by itself create a contract. Where the order and these Terms differ, the order prevails.
The trial period is the first month and it is free of charge. We set up and launch the service; the first month from the start date is not charged and payment starts from the second month. The trial period is part of live operation, not a separate mode — you work with real data in it. During it and after it, the contract may be terminated without giving a reason and without penalty. Notice sent by e-mail from the Customer’s contact address no later than the last day of the first month takes effect on the day it is sent — the notice period under Article 17 does not apply to it and the provision of Article 21 on delivery of e-mail does not apply to it. If the contract ends in the first month, the Customer pays nothing. We will delete the data under Article 17 (usually within 30 days of the end); the Customer may ask for it to be handed over sooner.
The contract is concluded for an indefinite period, without any minimum term commitment, unless the order expressly provides otherwise.
4. Set-up and launch
We set up the service, not the Customer. We create the company, the premises, the accounts and their permissions, import the product range from the Customer’s materials and train the staff. For this we need cooperation — in particular the list of the product range, the list of persons who are to have access, and the scope of their permissions. Without cooperation, the launch date is postponed.
The Customer acknowledges that we carry out the set-up and later changes in the administration of the service. To make that possible, we have technical access to the Customer’s data — its scope, rules and safeguards are described in the Data Processing Agreement.
5. Price and payment terms
The price is agreed in the order. It consists of a regular monthly or annual payment for running the service and any payments for custom changes beyond the agreed scope.
The prices agreed in the order and stated in the price list are prices exclusive of VAT. The Provider’s tax status is stated in Article 1. If the Provider is not a VAT payer, no tax is charged and the Customer pays the agreed amount; the stated prices are then final. If the Provider becomes a VAT payer, the Provider will add VAT at the statutory rate to the agreed prices, applying to billing statements issued from the day of its registration; billing statements already issued do not change. Adding VAT, or a later change of the statutory rate, is not a change of price under Article 18. We will inform the Customer of the registration without undue delay.
- We usually issue billing statements monthly, after the end of the billing period to which they relate; the period is stated on the billing statement. One-off services and changes from that period thus fit into the billing statement. We send billing statements by e-mail to the address designated by the Customer. An annual payment is an exception — it is paid in advance for the whole period.
- Payment is due 14 days after issue unless otherwise agreed in the order. We do not agree on due dates longer than 60 days.
- Payment is made by bank transfer to the account stated on the billing statement. We do not use payment cards or a payment gateway and we do not store payment card data.
- With an annual payment, payment is made in advance for the whole period and the unused part is refunded. If the contract ends during the prepaid period, we will refund the unused part of the price to the Customer within 15 days of the end of the contract. If the contract ended because we gave notice, because the Customer withdrew from it due to our material breach, or because the Customer gave notice for disagreeing with a change of the Terms or of the price under Article 18, we will refund the proportionate part of the price for the unused period — the annual-payment discount is retained. In other cases, in particular where the Customer itself ends the prepaid period, the months used are recalculated at the regular monthly price without the annual-payment discount and we will refund the difference between the price paid and this recalculation; months provided free of charge are not included in the recalculation. The amount refunded cannot be negative — we do not claim any additional payment from the Customer.
- The price can be changed only under Article 18: by notice at least one month in advance, at most once every 12 months and within a limited range; a Customer who does not agree with an increase may terminate the contract. A change never affects a period that has already been prepaid.
6. Late payment and restriction of the service
We deal with non-payment by agreement before restricting access. The procedure is predictable:
- After the due date passes without payment, a 14-day grace period runs, during which the service continues without restriction.
- During this time we send reminders, usually every three days.
- If payment has not been made even after 14 days, we may restrict access to read-only — logging in and viewing data continue to work, only new entries cannot be made. We will inform you of this restriction in advance.
A read-only restriction is not deletion. Under a restriction for non-payment, the Customer’s data remains untouched on the server and the Customer can still see it — only writing is restricted. After the amount owed is paid, we will restore full access without delay, usually on the same working day. We delete data only after the contract has ended, and by the procedure in Article 17.
For the duration of the delay we are entitled to statutory default interest. If the delay continues for more than 30 days after access was restricted to read-only, we may withdraw from the contract; this does not affect the right to payment of the amount owed.
7. Operation and availability
We do not guarantee any percentage availability. We do not agree to an SLA of the “99.9%” type and we do not provide discounts or contractual penalties for outages. We promise only what we can keep — and that is described below.
What we actually do:
- We run the service with the aim of continuous operation and we monitor its availability.
- We start dealing with an outage without undue delay after we learn of it.
- We announce planned downtime in advance, usually at least three days, and we schedule it outside the Customer’s normal operating hours. We do not announce short updates that do not interrupt operation.
- We carry out downtime without prior notice only if it is necessary for security reasons or to prevent imminent damage.
The service runs on servers in the European Union. We have no influence over the availability of the Customer’s network or devices, or over outages of the data centre or connectivity provider; we are not responsible for those.
Tapping to record works even without the internet. Entries made on a tablet during a connection outage are stored in the device’s browser and are sent as soon as the connection is back. Clearing the browser data, uninstalling, or damage to the device before sending means the loss of entries not yet sent; we are not responsible for that.
8. Backups and data recovery
- From the start of operating the service for the Customer we undertake to back up the database once a day, store the backups encrypted outside the server on which the service runs, and keep them for 30 days; after that we overwrite them.
- Backups serve solely to restore operation after a failure. They are not used for any other purpose.
- Recovery from a backup may be requested; we usually restore the whole state of the Customer’s database as of the time of the backup. We do not guarantee recovery of an individual record.
- Recovery from a backup loses the changes made between the backup and the failure. We do not promise zero data loss.
Backups do not replace the Customer’s own records. We recommend requesting the data at regular intervals and keeping it outside the service as well; the procedure is in Article 14.
9. Support
We provide support by e-mail at podpora@pridom.cz. We respond to reports on working days, usually within one working day. We do not guarantee a fixed deadline for resolution; faults that prevent use of the service are handled as a priority.
We do not charge for fixing an error. If the service does not do what was agreed, or we misunderstood the assignment, we will correct it without charge. Only changes by which the Customer extends or alters the agreed scope are paid; we agree the price for those in advance. The agreed scope is the order — in particular the parts of the service selected in it, the number of premises and custom adjustments — and the assignment we have confirmed with the Customer by e-mail.
10. One-off services
Besides running the service for the Customer, we also prepare separate things not directly connected with it — in particular a website or e-shop, a company profile on the internet, QR codes, e-mail on the Customer’s own domain, a custom address of the system, connection to an accounting program or publishing an app in an app store. They are ordered separately — by an order, by an amendment to it or by confirmation by e-mail — and are governed by the prices in the price list valid at the time of ordering.
- After payment, the result belongs to the Customer. A finished website or e-shop, graphic materials, QR codes and an established company profile are the Customer’s; the Customer may continue to use them, change them and transfer them to another provider, without limitation in time or territory. Article 15 does not apply to them — it concerns the software of the service itself. Conversely, publishing an app in an app store changes nothing about the ownership of the service’s software; the developer account and the store listing belong to the Customer, while the software remains ours under Article 15.
- We set up domains and third-party accounts in the Customer’s name and the Customer is the holder from the outset — the registered domain, the company profile, the mailbox and the developer account. The Customer pays third-party fees; if we pay them on its behalf, we will pass them on to the Customer at the actual amount. We will hand over the access credentials on request.
- Operating services run as long as they are paid for. Hosting of a website or e-shop and e-mail on a domain are charged regularly alongside the price for operating the service and may be terminated separately by the procedure in Article 17.
- Ending an operating service does not affect the operation of Evikom, and vice versa. If the Evikom contract ends, a hosted website or mailbox does not end by itself — they either continue separately or, at the Customer’s request, we will transfer them to another provider. If we do not agree within 30 days of the end of the contract, we will end the operation and hand over the website data to the Customer by the procedure in Article 14.
- If a hosted website includes an e-shop, we process the personal data of its customers in the process; the conditions are governed by the Data Processing Agreement.
We agree the delivery date for each service separately. Third-party prices (domain registration, the app store fee, the mailbox plan) are not our price and may change independently of us; we will announce a change as soon as we learn of it.
AI automation
A special case of a one-off service is AI automation — a custom automation in which part of the work (for example reading an invoice from an e-mail, drafting a reply to a customer or compiling an overview) is done by an artificial intelligence model. Evikom itself does not use artificial intelligence to work with customers’ data; it comes into play only when the Customer orders an AI automation. It is ordered by an order, by an amendment to it or by confirmation by e-mail, and the following rules apply to it:
- Price beforehand. We agree the one-off price for building the automation beforehand, according to the AI automation price list valid at the time of ordering; we do not start, and charge nothing, until the Customer has agreed to the price. Alongside it, a monthly fee for operating and monitoring the automation, which runs on our server, is payable. The price of operation and monitoring and the included volume of use are agreed beforehand together with the price of building, and change only under Article 18; we announce any excess over the included volume in advance, and an increase applies only by agreement with the Customer. We always state the price of any later change beforehand.
- Approval by a person. Anything the automation sends out (to a customer, a supplier, an authority) or writes into the accounts is released only after approval by a person designated by the Customer. Automatic replies without approval (for example a chat on a website) we set up only at the Customer’s express request and within a scope the Customer approves; what the automation cannot answer, it hands over to a person.
- Checking the output. The output of artificial intelligence may be wrong or incomplete, so the Customer checks it before approving. We are not liable for an output that is recognisably wrong and that the Customer approved, or for automatic sending without approval that the Customer expressly requested; we are liable for errors in our set-up of the automation under Article 16.
- AI labelling. People who communicate directly with artificial intelligence (for example in a chat on a website) are informed at the start that they are communicating with artificial intelligence (Article 50 of Regulation (EU) 2024/1689); the Customer does not remove this notice. We label content generated by artificial intelligence where Article 50 requires it.
- Data only for this automation. We process the Customer’s data only for the given automation and under the Data Processing Agreement. The text of documents and messages is passed during processing to the provider of the artificial intelligence model named in the list of sub-processors, which also states where the data is processed. The Customer does not send into the automation data that does not belong in the service under Article 11.
- Cancelling the operation means switching off. The automation runs as long as the operation is paid for. The Customer may terminate the operation by the procedure in Article 17; on the day it ends we switch the automation off and delete its data under Article 17. The source code of the automation remains our work under Article 15; its handover to the Customer is governed by the work protection agreement and any special written agreement.
11. Accounts, access and the Customer’s obligations
The Customer undertakes to:
- Designate the persons who are to have access and the scope of their permissions, and keep this list up to date. In particular, notify us without undue delay that a person should no longer have access — for example after the end of employment. Until then the account remains functional.
- Ensure that login credentials, PINs and paired tablets are not shared with unauthorised persons. The Customer is responsible for actions taken under the accounts set up for it.
- Not enter into the service data that does not belong there — in particular special categories of personal data (health, nationality, trade-union membership and others under Article 9 GDPR), data about children, payment data or login credentials for other systems. The free-text fields (notes on movements, orders and suppliers) are not intended for this.
- Not attempt to gain access to other customers’ data, circumvent permissions, burden the service beyond normal use or extract data from it by automated means.
- Be responsible for the accuracy and currency of the data that it or its people enter into the service.
In case of breach of these obligations we may restrict the access concerned; if the breach is serious or repeated, we may withdraw from the contract. Before restricting access we will warn the Customer, unless imminent damage threatens.
12. Activity logs and the Customer’s employees
For every entry, the service records who made it and when, and keeps a log of logins and changes to settings. Without this, records in the system would make no sense.
These logs concern the Customer’s employees. The Customer is their controller and is responsible for informing its employees about the scope and manner of such logging and for having a legal basis for it. The Labour Code sets its own requirements for monitoring employees; the Customer must assess them, we cannot do so on its behalf. Details are in the Data Processing Agreement.
13. Personal data
With regard to the data that the Customer enters into the service, the Customer is the controller and we are the processor. The rights and obligations of both parties are governed by the Data Processing Agreement, which forms an integral part of the contract. How we handle data for which we are the controller is described in the Privacy Policy.
14. Customer data and its release
The data entered into the service belongs to the Customer. We do not use it for any purpose other than operating the service for this Customer, we do not provide it to third parties (other than sub-processors under the Data Processing Agreement), and we do not use it to create comparative, statistical or other products.
At the Customer’s request we will release the data in a machine-readable form (CSV or another common format) within 15 days of receipt of the request. Releasing data in the usual scope is free of charge; for repeated requests made more often than once a month we may charge according to the work actually spent, of which we will warn in advance.
The Customer exports stock and overviews itself directly in the application to CSV format, within the scope of the currently set filter and period. We prepare other data on request by the procedure in the paragraph above.
The service is not an archive of the Customer’s accounting, tax and payroll records. The obligation to retain them is imposed on the Customer by legal regulations; the Customer therefore requests the data before the end of the contract (by the procedure above), because we delete it after the contract ends (Article 17).
15. Intellectual property
The software, its source code, design and documentation remain our property even if parts were created to the Customer’s specification. The Customer obtains a non-exclusive, non-transferable right to use the service for its own business for the duration of the contract. This does not affect the results of one-off services under Article 10, which belong to the Customer after payment. The Customer must not hand over or make the software available to anyone who does not need it to operate it for themselves — in particular not to an agency or another software supplier so that they can build the same thing from it — nor — to the extent the law permits — reverse-engineer it or derive from it its own solution that it offers or promotes further. The EVIKOM designation is our trade mark applied for (application No. O-614759); by using the service the Customer acquires no rights to it. The application continues to carry the name of the Customer’s own company.
The Customer’s rights that cannot be excluded by contract — in particular the entitlements of a lawful user of a computer program under Section 66 of Act No. 121/2000 Coll., the Copyright Act (for example decompilation necessary to achieve interoperability with another program) — are not affected by this Article. The result of such a procedure may be used only for the purpose for which the law grants the entitlement.
Conversely, we expressly permit: having an in-house or external IT administrator and letting them run and manage the system; making minor adjustments of your own in the system for your operation; and showing the system to others and recommending it. That is not a breach of this Article.
The application may carry the Customer’s name and visual identity. This does not transfer to us any rights to the Customer’s brand, and the Customer grants us only permission to use it in the application and in setting it up.
16. Liability
The service is provided with professional care, but without any guarantee that it will work continuously and without errors. The Customer acknowledges that the data in the service is an operating record and that it makes decisions based on it at its own responsibility.
- We are not liable for lost profit, loss of a business opportunity, loss of goodwill, or indirect and consequential damage.
- We are not liable for damage caused by incorrect data entry by the Customer or its people, by loss or sharing of login credentials, or by the actions of persons to whom the Customer set up access or did not remove it.
- Our total liability to pay damages is limited to the amount that the Customer paid us for the service in the 12 months preceding the occurrence of the damage, but not less than CZK 12,000. The lower limit also applies if the service was provided free of charge or at a discount during the relevant period.
The limitations under this Article do not apply to damage caused intentionally or by gross negligence and to harm to the natural rights of a person, nor in other cases where the law does not allow liability to be limited, in particular under Section 2898 of the Civil Code in relation to the weaker party; to that extent we do not waive liability and cannot waive it. The same applies to any other exclusion or limitation of our liability in these Terms (in particular in Articles 7, 10 and 11).
17. Termination of the contract and the fate of the data
- Both the Customer and we may terminate the contract without giving a reason with a notice period of one month, which starts to run on the first day of the month following delivery of the notice.
- It is sufficient to give notice and to withdraw by e-mail from the other party’s contact address.
- Withdrawal from the contract is possible in case of a material breach that has not been remedied even within a reasonable additional period.
After the contract ends:
- Within 15 days we will hand over the Customer’s data in a machine-readable form, if the Customer requests it no later than 30 days after the end of the contract.
- We will end access to the service on the day the contract ends.
- We will delete the data within 30 days of the end of the contract, or within 15 days of handing it over under point 1, whichever is later — so that a request for handover made near the end of the thirty-day period does not conflict with deletion. A longer period may be agreed; we will not delete the data only to the extent that a legal regulation requires us to retain it for longer (in particular the billing statements we have issued to the Customer). The data disappears from backups within 30 days at the latest after the backups are gradually overwritten.
Switching to another provider. The Customer may request to switch to another service provider or to its own infrastructure (Chapter VI of Regulation (EU) 2023/2854, the Data Act, in particular Article 25). A notice of switching sent by e-mail from the Customer’s contact address is deemed notice of termination. We will start the switching on the day the Customer designates, at the latest within 2 months of the notice. The transition period lasts at most 30 days from the start of the switching; throughout it we continue to provide the service and assist with the switching. After the transition period ends, the Customer has at least 30 days to retrieve the data and until then we do not delete it.
We release: documents and their attachments, suppliers, movements, stock, users and permissions, and activity logs, in a machine-readable form (CSV and PDF). We do not release source code, the configuration of our infrastructure, or internal operating data and trade secrets. We charge no fees for the switching and the release of the data; charging for repeated exports under Article 14 does not apply to it. For switching, this paragraph prevails over points 1 to 3 above and over the 15-day period in Article 14.
18. Changes to the Terms and to prices
We may change these Terms unilaterally only for the reasons stated below. We will announce a change by e-mail at least one month in advance. If the Customer does not agree with the change, it may terminate the contract by the day the change takes effect, with effect from the day on which the change is to take effect; until then the existing wording applies. If it does not terminate, it is deemed to have accepted the change.
Changes to prices. We may change the price list at any time — raise it, lower it or otherwise adjust it — and a change to the price list applies to new orders from the day we state in the price list. We may also change the price for operating the service that the Customer agreed when the contract was concluded (including any discount, tariff and number of accounts) for an existing Customer, but only as follows:
- we will announce the change by e-mail at least one month in advance; the notice states the new price and the day from which it applies;
- we will raise the price at most once every 12 months and by no more than the rate of inflation, expressed as the increase in the consumer price index announced by the Czech Statistical Office for the previous calendar year, or by 10%, whichever is higher; we may lower the price at any time;
- a Customer who does not agree with a price increase may terminate the contract without penalty by e-mail with effect from the day the increase is to take effect (or earlier); the notice period under Article 17 does not apply to such termination, and the existing price applies until the contract ends. If the Customer does not terminate, it is deemed to have accepted the change.
A change of price never affects a prepaid period.
These limits do not apply to the following changes of price, which can therefore be made without them:
- by agreement of the parties;
- the Customer itself extends the scope — moves to a higher tariff, adds further accounts, switches on another part of the service or orders an additional service. The price of the existing scope stays the same; the new item is governed by the price list valid on the day of the extension;
- the price of a third party that we merely pass on changes (for example sent text messages or an app store fee); we pass it on at the actual amount and announce the change as soon as we learn of it;
- the VAT rate changes or the Provider becomes a VAT payer under Article 5;
- the period for which a discount was agreed expires (for example the founding-companies discount in months 2 to 12) — a return to the price without the discount is not a price increase under this Article.
Reasons for and scope of unilateral changes. We may unilaterally change these Terms (including annexes) only for the following reasons:
- a change of a legal regulation, of a binding decision or of the interpretation by a public authority that concerns the service;
- the need to ensure the security of the service and the protection of data;
- the introduction, change or discontinuation of features of the service or related technical changes, including a change of sub-processors under the Data Processing Agreement;
- a change in the prices of third parties that we merely pass on, to the extent stated above;
- removing ambiguities and contradictions in the text.
A change of the Terms must not fundamentally alter the subject of the service or change the agreed price other than as stated above. The notice contains the new wording or a description of it, the reason for the change and the effective date, and is delivered at least one month in advance. The Customer has the right to terminate the contract without penalty with effect from the effective date of the change (or earlier), by e-mail; the notice period under Article 17 does not apply to such notice.
Changes that merely clarify the text without affecting the parties’ rights and obligations, and changes required by a legal regulation, may be made even without this period.
19. Confidentiality
Both parties will keep confidential the information of the other party that has the nature of a trade secret or is marked as confidential, and will not use it for any purpose other than performance of the contract. The obligation continues after the contract ends. It does not apply to publicly available information or to cases where disclosure is required by a legal regulation or a public authority.
20. References
We do not cite the Customer as a reference without its consent. We will not use its name, logo or any description of its operations in our materials until it gives us written or e-mail consent. Consent may be withdrawn at any time and we will remove the reference within 30 days.
21. Final provisions
- The contract and these Terms are governed by the law of the Czech Republic. Any disputes are decided by the courts of the Czech Republic.
- The parties agree, under Section 89a of Act No. 99/1963 Coll., the Code of Civil Procedure, on the territorial jurisdiction of the court: for disputes arising from the contract, the court in whose district the Provider has its registered office (Čáslavská 1825/9, 737 01 Český Těšín) has jurisdiction.
- E-mail to the parties’ contact addresses is sufficient for communication.
- An e-mail is deemed delivered as soon as the addressee confirms receipt, but no later than the third working day after sending to the address stated in the order (for us, to the address in Article 1). This does not apply if the sender receives a notice that the message was not delivered. The same applies to notice of termination and to withdrawal; the sender should therefore keep the message sent. Each party is obliged to keep its address functional and to notify any change.
- The Customer may not assign rights and obligations under the contract without our consent. We may assign the contract in the event of a transfer of the business or part of it; we will notify the Customer in advance and in such a case it may terminate the contract with immediate effect.
- If any provision is invalid or ineffective, the rest of the Terms is not affected.
- The Data Processing Agreement and the list of sub-processors are an annex to and an integral part of these Terms.
22. Defects of the service and complaints
A defect is a condition in which the service does not correspond to what was agreed (Article 9 determines what the agreed scope is). Availability of the service is governed by Article 7; an outage by itself is not a defect giving rise to a claim for a discount.
- The Customer reports a defect by e-mail to podpora@pridom.cz without undue delay after discovering it, and describes how it manifests itself and how to reproduce it.
- We will usually respond within one working day and remedy the defect without undue delay and without charge (Article 9). We do not promise a fixed deadline; defects that prevent use of the service are handled as a priority.
- If a defect cannot be remedied or we do not remedy it within a reasonable time, the Customer has the rights from defective performance under the law, in particular the right to a reasonable discount on the price for the duration of the defect and, if the defect relates to a substantial part of the service, the right to withdraw from the contract.
- A defect is not a condition caused by incorrect input by the Customer, by the intervention of a third party or by circumstances beyond our control referred to in Article 7.
